Meet regulations to sell tyres on Trade Me

Selling tyres on Trade Me? Make sure you’re pumped up to comply with the latest regulations

The regulations currently cover all pneumatic (air filled) and solid tyres for motorised vehicles.

The government released the Waste Minimisation (Tyres) Regulations 2023 to prevent end-of-life tyres from ending up in landfills or the environment. The regulations currently cover all pneumatic (air filled) and solid tyres for motorised vehicles, including most machinery, equipment, and trailers.

To comply, all importers and sellers of regulated tyres (or vehicles with regulated tyres) must register with Tyrewise and transparently declare any stewardship fees they pass on to buyers.

What the regulations say

The regulations prohibit the sale of regulated tyres except in accordance with the accredited scheme, Tyrewise. The regulations set the fees payable for the management of regulated tyres and specify who must pay the fee and when the fee must be paid. The fees must be paid by:

  • Importers of loose regulated tyres if the Customs value of the importation entry containing those tyres is more than $1,000.
  • Importers of off-road motor vehicles and aircraft that have regulated tyres attached to them.
  • A person that registers a motor vehicle (with regulated tyres attached to it) that has not previously been registered.
  • A person that manufactures a loose regulated tyre in New Zealand (tyres that are retreaded in New Zealand are not manufactured in New Zealand for the purposes of these regulations).

From 1 March 2024, all tyre retailers will charge their customers the relevant stewardship fees on regulated tyres at point of sale.

Tyres being sold on imported vehicles (whether brand new or previously owned) will be charged the tyre stewardship fee by NZTA Waka Kotahi when it is first road registered.

If you’re selling tyres or an imported vehicle on Trade Me, you must transparently declare stewardship fees to the buyer.

How to comply as a seller on Trade Me

  1. 1. Register with Tyrewise to receive a unique ID. If you haven’t declared your tyre import through NZ Customs, you must complete the self declaration form.
  2. 2. Include any stewardship fees you’ve been charged in the listing price. The importer or wholesaler would’ve charged you these fees initially. If you’re also the importer, the Ministry for the Environment would’ve charged you the fees during your NZ Customs or self-declaration.
  3. 3. Declare the stewardship fee’s purpose and amount in your Trade Me listing and on the receipt you supply to your customers.

For example, use wording like:

The Buy Now price of this tyre includes the tyre stewardship fee of $XXX. More information about this fee is available on the Ministry for the Environment website:www.environment.govt.nz/tyre-stewardship.

If you’re selling tyres on an imported vehicle, let the buyer know the stewardship fee is part of the on-road costs. Include a breakdown of these costs on the invoice or sales agreement if road registration is part of the sale.
